In an action, inter alia, to recover damages for a breach of fiduciary duty and fraud, the appeal is from an order of the Supreme Court, Nassau County (Samenga, J.), entered September 24, 1985, which denied the appellants’ motion to dismiss the complaint pursuant to CPLR 3211 insofar as it is asserted against them.
Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint is dismissed insofar as it is asserted against the appellants, with prejudice, and the action insofar as it is asserted against the remaining defendants is severed.
