The decision of this court in St. Nicholas Cathedral v. Kedroff (302 N. Y. 1), directing judgment in favor of the plaintiff, i.e., the group known as the “ Russian Church in America,” has been reversed by the Supreme Court of the *41United States in a majority opinion written by Mr. Justice Reed, and the case has been remanded to this court “ for such further action as it deems proper and not in contravention of this opinion.” (Kedroff v.
