Appeal from a judgment entered May 8, 1915, upon an order of the Appellate Division of the Supreme Court in the fourth judicial department, reversing a judgment in favor of plaintiff entered upon a decision of the court on trial at Special Term and directing a dismissal of the complaint. The nature of the action and the facts, so far as material, are stated in the opinion.

This action was brought by the beneficiary of a trust for an accounting by trustees, and for the preservation of the trust estate.
On July 31, 1903, Cassius M. Carrier, Annie O. Carrier, his wife, and the Fidelity Trust Company of Buffalo, became parties to a written agreement. The agreement recites the desire of the parties of the first and second parts “ to provide against the contingencies of business, and to provide further for the welfare of their two daughters,” Olive, then of the age of twenty-three years, and Frances, then of the age of five.
