Hilton, Justice.

Action to recover damages for personal injuries sustained by Melvin Mesedahl, incompetent, alleged to have been caused by the negligence of the employes of the defendant hospital association. The case was tried to a court and a jury. , A verdict for $24,648 was returned in favor of plaintiff. The trial court ordered a new trial unless plaintiff consented to a reduction of the verdict to $16,000. Plaintiff duly consented to the verdict as reduced.
