SANBORN, Circuit Judge.

This is an appeal from a decree that the bill of John H. Powell, the trustee in bankruptcy of the estate of the John C. Humes Crockery Company, a corporation, against Gate City Bank, a corporation, and R. A. Clark, be dismissed. The bill was founded on the facts that between the 18th and 25th days of June, 1908, and within four months of the filing of a petition in bankruptcy against the Humes Company, R. A. Clark loaned to it, on the security of a part of its merchandise, $30,000, with which that company paid notes to the amount of $25,000 which it owed to the bank and…
