David Roth (Defendant) appeals the trial court’s judgment after a jury verdict found him hable to Frank Roth III (Plaintiff) for payment of $20,000 on a promissory note. We reverse and remand to the trial court for a new trial. 1

Facts

On May 11, 1992, Plaintiff and Defendant entered into a promissory note whereby Defendant agreed to pay Plaintiff $27,859.56 plus interest at the rate of 7.5 percent per annum.
