The plaintiff in error, hereinafter referred to as the defendant, was convicted of abortion and sentenced to- serve a term of two^ years in the state penitentiary at McAlester, and appeals.

The defendant was charged and convicted of violating section 1834, Okla. Stats. 1931, which is as follo ws:
