This is an appeal from the district court of Wagoner county. In this ¿ase, tile plaintiff below filed a motion for judgment upon the pleadings which was sustained by the court, and judgment rendered thereon as prayed for.
The principal question for determination rests on these facts:
On the 6th day .of September, 1913, the defendants Eliza Damet and John P.
