Appeal from St. Louis City Circuit Court. — How. Matt. G. Reynolds, Judge. Exception was preserved to the action of the court in overruling said motion. Shooting with intent to kill Woehrle will not sustain a charge of shooting with intent to kill Dorn, simply because the shot took effect upon Dorn.
