This action involves a challenge by plaintiffs, representing various patients, pharmacists, physicians, drug companies and the Medical Society of the State of New York, to the adoption and implementation by defendant Dr. David Axelrod, Commissioner of Health of the State of New York, of a regulation (10 NYCRR 80.67) which was scheduled to take effect on July 1, 1987.
