Presently before the Court is the Report and Recommendation of Magistrate Judge Thomas M. Blewitt. (Doc. 35). The Magistrate Judge recommends that the Defendant’s Motion to Dismiss for lack of subject matter jurisdiction (Doc. 8) be granted and that the Plaintiffs complaint be dismissed for lack of subject matter jurisdiction. As the Plaintiff has filed objections to the Magistrate Judge’s recommended disposition, we shall review the matter de novo. See Cipollone v.
