This matter presents competing First Amendment interests between a non-party reporter asserting a First Amendment reporter’s privilege and a plaintiff seeking to vindicate his First Amendment free speech rights. The plaintiff Bruce Peck, a former street performer, has filed a lawsuit, pursuant to 42 U.S.C. § 1983, against the City of Boston in the District of Massachusetts. Peck v.
