MR. JUSTICE ANGSTMAN:

This is an appeal from a judgment admitting the will of Violet W. Swords to probate. The facts giving rise to the controversy are these:

Violet Williams Swords died on the 1st day of November, 1952, at Billings. On November 14, 1952, George W. Swords, II, filed in the district court of Yellowstone County a petition for the probate of her will dated May 2, 1951.
