BACKGROUND

On March 27,1998, plaintiff, Dr. Michael Galvin (“Dr.Galvin”), a professional equine veterinarian specializing in thoroughbred racehorses, was present in Barn 38 at the Belmont Park racetrack, treating horses that were under the supervision of trainer Mitch Friedman (“Friedman”).
