Ivan Antonio Mejia, the petitioner, on trial in the Circuit Court for Montgomery County for rape and related sexual offenses, challenged, as discriminatory, the State’s use of one of its peremptory challenges to exclude a venireperson the petitioner alleged to be Hispanic. The court overruled his objection and the trial proceeded, resulting in the petitioner’s conviction of attempted rape in the second degree and second degree sexual offense.
