Plaintiffs, twenty bus operators employed by Defendant Penn-Harris-Madison School Corporation, filed a claim for unpaid overtime compensation pursuant to the Fair Labor Standards Act (“the FLSA”) and the Indiana Wage Statute on October 15, 2001. Plaintiffs moved for Partial Summary Judgment on October 15, 2002, alleging that mandatory bus inspections and all drive time should be included as hours worked under the FLSA.
