Petitioner, Posie Jones (hereinafter petitioner), appeals from an order sustaining the State’s motion to dismiss his post-conviction petition without an evidentiary hearing. (Ill. Rev. Stat. 1971, ch. 38, par. 122 — 1 et seq.) On the appeal, petitioner contends that the post-conviction court should have held an evidentiary hearing on his allegations that his retained trial counsel was incompetent and that he was convicted as a result of his identification in an impermissibly suggestive lineup.
