Harry D. Gurley Jr. filed, in the Superior Court of Chatham County, Georgia, his petition, which as amended alleges substantially: that he was indebted to the Savannah Bank & Trust-Company for a large amount of money, which debt was secured by security deeds executed by the plaintiff to the bank covering a certain described real-estate subdivision, and that the plaintiff was also indebted to numerous materialmen; that, in order to stop foreclosure of the security deeds by the bank, a contract was entered into between the plaintiff, the bank, and the materialmen, wherein the…
