Order, Supreme Court, Bronx County (Bertram Katz, J.), entered on or about October 18, 1988, which struck defendant Sohn’s answer and denied defendants’ motion for appointment of a Referee, reversed, on the law, the facts, and in the exercise of discretion, without costs, the motion to strike is denied on the condition that defendant Sohn’s attorneys pay plaintiff $5,000 within 30 days of the date of this order.
