The plaintiff in error, hereinafter called defendant, was convicted in the district court of ■ Okmulgee county on a charge of perjury and was sentenced to serve a term of five years in the state penitentiary.

The information alleges-, in substance, that defendant was produced as a witness in the district court in a case wherein the state prosecuted one Jack Whitehead, charged with murder. That he was sworn as a witness by the deputy court clerk, and it then became a material question in the trial of said cause whether or not said Whitehead was present at the city of Beggs at the hour of 10:45…
