BURFORD, J. :

The plaintiff in error was charged by indictment on the Federal side of the district court of Oklahoma, county, with the crime of perjury, tried by jury, convicted, and sentenced to pay a fine of one doUar, and that he be imprisoned for a term of four years.

The indictment charges in substance that, in the dis-, trict court of Oklahoma county on the 2d day of May, 1892, a certain cause was then and there pending, and came on to be tried, wherein the United States of America was plaintiff and Curt W. Blackburn was defendent, wherein the said…
