In the light of the motion for rehearing, both the law and the facts have been reviewed.

Robert McRay Wood, the deceased, was a young man about 20 years of age. His father was a tenant upon the farm of the appellant. On the morning shortly before the homicide, the appellant, in company with a negro, went in a wagon to the home of Lester Wood, a brother of the deceased, to get a corn sheller that had been loaned to Wood by the appellant.
