BUSSEY, Judge.
Urbie Pennington Rodgers, hereinafter •referred to as Defendant, was charged, tried and convicted for the crime of Bur;glary of a Coin Operated Machine After Former Conviction of a Felony, and from the judgment and sentence rendered against 'him fixing his punishment at from ten (10) ■to thirty (30) years imprisonment in the State Penitentiary at McAlester, a timely -appeal has been perfected to this Court.
