This is an action against the defendant, Dominic Raims, *490charging him with the violation of an ordinance of the town of Elyria regulating the sale of liquor. In the police magistrate’s court, where this action was originally brought, a fine was assessed against the defendant; from that judgment the defendant appealed, to the county court, where a trial was had by the court without a jury and the defendant was discharged. The plaintiff brings the case here upon writ of error.'
