MARTIN, Chief Justice.
This is an appeal from a judgment for the plaintiff entered by the lower court upon the pleadings in an action to recover upon a contract of insurance.
In the declaration filed in the lower court the plaintiff, John F. Moran, alleged that he was the duly appointed and qualified receiver of the Park Savings Bank, a corporation located in the city of Washington, D. C., under appointment of the Comptroller of the Currency, and that he brought this suit as such receiver.
