OPINION

GARBARINO, Judge.

¶ 1 The appellants were successful in having portions of an administrative decision and order set aside by the superior court and in having the matter remanded to the administrative law judge (ALJ) for further proceedings. This appeal questions only the superior court’s denial of the appellants’ request for attorneys’ fees against the Arizona Department of Transportation (ADOT) pursuant to Arizona Revised Statutes Annotated (A.R.S.) section 12-348(A)(2) (1992).
