The position of the parties, in respect to their descriptive titles, remains the same here as in the trial court. Plaintiff sold the Nix Pharmacy and installed in its place of business at McAlester, Okla., a soda fountain, with articles for use in connection therewith, including a pat ented carbonatar, for $1,100, of which $200 was paid at the time; the balance of $900 being evidenced by the purchaser’s notes secured by his chattel mortgage on all the property.
