On August 10, 2004, petitioner, Quality Saw & Seal, Inc. (Quality Saw), struck and damaged a 3/4-inch-thick underground natural gas transmission facility that was owned and operated by North Shore Gas Company (North Shore). The damage occurred while Quality Saw was “saw-cutting” concrete pavement in Highland Park.
