E. McCoy; and the plaintiffs in the summons claimed the sum of $200.00 as such damages.

The first inquiry is: Should the Circuit Court have dismissed the appeal awarded the defendant to the judgment of *746the justice in favor of the plaintiffs, by tbe order of the judge in vacation, on the petition of the defendant, supported by his affidavit, as improvidently awarded, the plaintiffs having made a motion to dismiss this appeal-as improvidently awarded ?
