Snyder, Judge:

This was an action of unlawful detainer brought by A. L. Ruffner and others against Ellen and Rate Love before a justice of Kanawha county to recover the possession of a tract of land in said county. The summons was duly served on the defendants and on the return day thereof, they failing to appear, the justice, after hearing the evidence, gave judgment for the plaintiffs on September 7, 1877. Afterwards the .plaintiffs obtained a writ of possession and were by the sheriff of said county put in the possession of said land. Ro application 'was made to the justice for an appeal,…
