CLARK, V. C. J.

This is an original action in this court by petitioners to review an award of the State Industrial Oommission, made and entered on the 24th day of July, 1931, in favor of Percy Morgan, respondent herein.

The Industrial Commission found:

• “(1) That on December ' 22, Y930,' .the .claimant was in the employment of the respondent and engaged in a hazardous occupation subject to and.covered by the provisions of the Workmen’s Compensation Law, and that on said date he sustained an accidental injury, arising out of and in the -course of his employment, to wit, an injury to his back.
