OPINION
DOUGLAS, Judge.
This is an appeal from an order in a habeas corpus proceeding wherein after hearing, Mace B. Thurman, Jr., Judge of the 147th District Court, refused to discharge appellant. The appellant has not been convicted but has been charged by indictment1 which reads as follows:
“THE GRAND JURY, for the County of Travis, State of Texas duly selected, empaneled, sworn, charged and organized as such at the October Term A.D. 1969 of the 147th Judicial District Court for said County, upon their oaths present in and to said court at said term that RICHARD EDWARD LeCLAIR, GREGORY SCOTT…
