OPINION AND ORDER

SCHELL, District Judge.

Plaintiff, Cornelia Louise Owens, sued Defendant, First City National Bank of Beaumont (FCNB), in the 60th District Court of Jefferson County, Texas, alleging malicious prosecution, intentional infliction of emotional distress, invasion of privacy and slander. FCNB timely removed the case to this federal court on the basis that the malicious prosecution claim allegedly depends upon the interpretation of criminal laws of the United States1 and laws which regulate conduct of national banks.2 Owens then moved this court to remand, arguing that the claims…
