This is an appeal from a judgment wherein the appellee was awarded $350.00 after trial by jury. The complaint was on an insurance policy issued on the life of Katie Jackson, wherein the appellant company agreed to pay the sum of $329.00 to the appellee as beneficiary upon the death of the insured. The appellant by its second paragraph of answer contended that there had been a material misrepresentation of the state of health of the insured at the time the policy was delivered and that the cause of death was heart disease, which was one of the exceptions in the insurance contract which…
