Statement of facts. — This is a petition by C. M. Hiers to have certain judgments set off against each other. The petition is as follows:
“1. That heretofore, to wit: on the 28th day of March, 1894, one Charles Ellis, as plaintiff, in an action in this Court between himself, as plaintiff, and one Jones H. C. All, as defendant recovered a judgment against the said Jones PI. C.
