District Judge, sitting in place of MR. JUSTICE MATTHEWS, disqualified, delivered the opinion of the court.

This is an appeal from the district court of Lewis and Clark county. The order appealed from is dated September 5, 1935, and in effect denies a motion of the appellant State Bank of Townsend to vacate and set aside the order of the trial court, dated April 13, 1935, dismissing the original action as to the State Bank of Townsend, a corporation, and to reinstate the action as to this defendant.
