Blake, J. —

Plaintiff brought this action to impress a trust upon land near Coulee City, Washington. The land was purchased February 9, 1932, on contract, by plaintiff’s deceased brother, W. G. Visser, from the North Pacific Mortgage Company. The contract price was $6,500. The contract recites a down payment of $1,500. The actual cash paid, however, was $1,275, the vendee being credited with $225 for taxes assumed and commission earned.
