OPINION

HUDSON, Justice.

Appellant, the Texas Department of Public Safety (DPS), challenges a county court at law judgment reversing an administrative order sustaining the suspension of appellee Carol Ann Cortinas’s license to drive. See Tex.Transp.Code Ann. § 524.011(a) (Vernon Pamph.1998); TexPenal Code Ann. § 49.01(2)(B) (Vernon 1994).
