The plaintiff brings this suit to recover from the defendant an amount alleged to be due for the proportional share of the defendant’s property in the cost of the construction of sidewalks along the front of the property under contracts let in pursuance of ordinances of the city council of the city of New Orleans, where the property is situated. Defendant filed a plea of no cause of action. The lower court sustained this plea. This court, however, overruled the plea, and ordered the case to be proceeded with according to law.
