This is a proceeding by the comptroller, under the Transfer Inheritance Tax act (P.L. 1909 ch. 228 § 21), against the executors of the last will and testament of Frederick A. Canfield, deceased, and the trustees of Rutgers College, as legatee, under said will; for the collection of a tax of $3,390 assessed in respect of the testamentary transfers to the said legatee.
