— Appeal from the judgment of the Supreme Court, New York County (Rose L. Rubin, J.), rendered on December 13, 1985, convicting defendant, following a jury trial, of criminal possession of a controlled substance in the fourth degree and sentencing him, as a predicate felon, to an indeterminate term of imprisonment of from 3 to 6 years, is held in abeyance and the matter remanded for a hearing to *506determine whether defendant received the effective assistance of counsel so as to knowingly and intelligently waive his right to move to set aside the judgment of conviction.
