Layton, Judge.

It is quite clear to me that Plaintiff’s letter of March" 7th and the oral representations above set forth formed no part of the contract between the parties. The letter of May 10th (in which the proposal was enclosed) states that what was enclosed was a “firm proposal.” The inference from this is that all discussions and negotiations up to that time had been preliminary. Even the letter of March 7th contains the pertinent statement “any time you wish to discuss this matter further * * * we will be glad to discuss the matter further with you.” If any doubt remains that the…
