BELL, Chief Justice.

This is an appeal from a summary judgment rendered in favor of appellees in response to their motion for summary judgment.

Appellant N. R. Wall was a real estate agent. On February 1,1946, he entered into a contract with appellee Ayrshire Corporation under the terms of which he was given the exclusive sales agency to sell the lots into which certain property should be thereafter subdivided.
