BELL, Chief Justice.

Gerald F. Stone sued James Williams: and his wife, Ruth Williams, and H. C.. Williams, the brother of James Williams.. We will hereafter refer to James and' Ruth Williams as appellees. The suit as; reflected by appellant’s third amended original petition was in trespass to try-title whereby he sought to recover title and possession of the East ½ of Lot 12’ and all of Lot 13 in Block 12 in Blossom) Heights, Section 2, an addition in Harris: County out of the E.
