May 1, 1906, the parties to this suit entered into a written contract, whereby Powell agreed to work for Bilz in his “automobile business, and to give his whole time and energy to said business, and at all times to conduct himself in a sober and gentlemanly manner, and to use his best efforts to1 make sales of automobiles and automobile equipment for Bilz.” Bilz agreed to pay Powell for his services $15.00 per week and “a commission of five per cent.
