The issue in this case is whether the insurance coverage provided by American Steamship Owners Mutual Indemnity Association (“American Club” or “Club”) to defendant Lafarge North America (“La-farge” or “LNA”) extends to a particular barge that was owned and operated by another company that had contracted to transport cement for Lafarge. The American Club seeks a declaratory judgment that the barge was not covered under its policy and thus that it is not responsible for any potential liability or defense costs associated with the barge.…
