IN THE COURT OF CRIMINAL APPEALS OF TEXAS NO. PD-1682-11 ADBIHAKIM HASSAN, Appellant v. THE STATE OF TEXAS ON STATE’S PETITION FOR DISCRETIONARY REVIEW FROM THE FOURTEENTH COURT OF APPEALS HARRIS COUNTY K ELLER, P.J., delivered the opinion of the unanimous Court. The State used its only three peremptory challenges to strike two African-Americans and an Asian in a fourteen-person venire that was made up predominantly of racial minorities. The court of appeals held that appellant had established a prima facie case of racial discrimination under Batson v. Kentucky.1 We disagree and reverse. 1
