ORDER
KARLTON, District Judge.
The instant action is before the court on the federal defendants’1 motion to dismiss or in the alternative for summary judgment. Defendants Butte County and James Rackerby (hereinafter “local defendants”) have joined in said motion. Below I *523will set forth the factual background against which the present motion must be considered.
