The court, sitting pursuant to its diversity jurisdiction under 28 U.S.C. § 1332(a), has before it the motion of the defendants, D & D Oil Company, Inc., Superior Transport, Inc., The Pantry, Inc., and Larry Martin (hereinafter referred to collectively as “Defendants”), for summary judgment on the claims of the plaintiff, Moore Oil Company, Inc.
