Error from District Court, Tulsa County; L. M. Poe, Judge. Action by the Dux Oil & Gas Company against Sam Wilson and another, in which J. A. Bearman intervened. There was a judgment for plaintiff, and intervener brings error.

This action was commenced' in the superior court of Tulsa county by the Dux Oil & Gas Company, hereinafter referred to as plaintiff, against Sam and Lulie Wilson, who will be referred to as defendants, seeking-'to enjoin said defendants from interfering- with plaintiff; in exploring for oil and gas under a certain oil and gas lease executed by defendants. Plaintiff in error, J. A. Bearman, who will be referred to as intervener, was permitted to intervene. The case was afterwards transferred to the district court of said county.
